Russian Federal Antimonopoly Service (FAS Russia) announced on their web-site www.fas.gov.ru on May 31, 2010 that it was launching an investigation into JSC Chelyabinsk Zinc Plant (“CZP”) in relation to alleged abuse of a dominant position on the zinc market. According to FAS Russia, during the course of a review of the zinc market in 2008 – 2010, FAS Russia found that CZP was in breach of Article 10.1(6) of the Federal Law on Protection of Competition as a result of setting differing prices for the supply of zinc to Russian and foreign customers, respectively, that could not be substantiated on economic, technical or other grounds; FAS Russia also alleged that CZP was in breach of Article 10.1(8) of the Federal Law on Protection of Competition for discriminating against Russian customers compared to foreign customers in setting terms for the supply of zinc produced by CZP.
