Perm. Federal Arbitrary Court of the Ural Area confirmed that the claim of Inter-district Inspectorate of the Russian Federal Tax Department of Perm Region against TGC-9 are invalid.

The Inter-district Inspectorate of the Russian Federal Tax Department of Perm Region ? 16 admitted that OJSC “TGC-9” (represented by the branch “Zakamsk HPP-5”) in the second quarter 2006 consumed water over the set quarter limits, so the Inspectorate imposed the charge of five times water tax on the company. According to the article 22 of the Russian Federation Tax Code the Tax Authorities took the resolution to institute proceedings against TGC-9 for underpaying water tax and demanded the Company to pay the penalty fee at about 6,99 mln rubles (water tax - 5,66 mln. rubles, penalty fee - 197,5 thousand rubles and penalty provisions - 1,13 mln. rubles).

Nevertheless OJSC “Territorial Generating Company ?9” proved that within 2006 the water consumption by Zakamsk HPP was conducted in agreement with the established limits. And according to Resolution dated 20.12.2006 of Arbitrary Court of Perm Territory, Tax Authority demands were adjudged as invalid. The resolution of the court of first appearance is left unchanged by the order of the Arbitrary Appealing Court ?17 and The Federal Arbitrary Court of the Ural Area. Thus, OJSC “TGC-9” is a company, the operating process of which fully complies with the RF Water and Tax Legislation.
