IDGC of Volga recovered by courts more than 4.5 billion rubles of debt for electricity transmission services

During the first 11 months of this year, the court considered cases on collecting from non-paying customers more than 16.2 billion rubles of debt for electricity transmission services rendered by IDGC of Volga, PJSC (a member of Rosseti Group of Companies). Pending a decision of the court, some of the debtors repaid their debts at a rate of almost 11.9 billion rubles.

As of December 01, 2016, 573 claims were settled in favor of energy companies. At that, the penalties for violators of contractual obligations amounted to over 264 million rubles. The court in fact recovered more than 4.5 billion rubles.

Despite the fact that IDGC of Volga, PJSC prefer to solve the problem of debts for electricity transmission services in a mode of dialog, defaulters persistently demonstrate their unwillingness to comply with the conditions of the concluded contracts. For months, they continue to operate at the expense of power grid companies. Russian legislation implies the use of such measures as the electricity supply limitation to the defaulters; however, the presence of their own bona fide subscribers deprives IDGC of Volga, PJSC of such opportunity. In fact, the only effective way of debt collection is the longest — claim-related.

In any case, defaulters have to repay their debts. If they don't want to do it on their own, they will have to execute the court's judgments, which in most cases are made in favor of IDGC of Volga. And the debtors will have to pay both the court costs and penalties for failure to comply with the terms of payment for electricity transmission services. According to the accepted this year Federal Law No. 307-FZ, legal entities are now charged an interest of 1/130 of the refinancing rate of the Bank of Russia from the amount not duly paid for each day of delay. For the debtor companies their payment delays can amount to millions rubles.
