In 2003 AO MOSENERGO launched four court actions against the Moscow REC

On July 8, Moscow Mayor Yury Luzhkov again voiced the Moscow government’s opinion of AO MOSENERGO operations. In particular, the Moscow mayor expressed his discontent with AO MOSENERGO's tariff policy. However, he did not say that electricity and heat tariffs for all Moscow consumers are set by the Moscow government and that tariffs are the only source to finance and maintain the Moscow power system.

The "efficiency" of the Moscow government tariff policies is best illustrated by the fact that AO MOSENERGO has managed to overrule two Moscow government decisions that set too low tariffs for some organizations. For example, the Moscow government categorized the Moskvich Cultural Center and Investstroiindustriya as budgetary consumers. This decision violated several federal laws and decrees of the Russian government by introducing low tariffs for these organizations and considering them as budgetary consumers. The Moscow Arbitration court invalidated these decisions of the Moscow government.

At the same time, the Moscow arbitration court did not support AO MOSENERGO's claim on illegality of "economic development" tariffs, which were introduced by the Moscow Regional Energy Commission. In accordance with this Moscow REC's decision, Moscow companies can pay for electricity at a discount if they implement power saving programs. The REC's decision did not provide for financing sources, thus making other consumers pay for discounts. This decision also introduced unequal conditions for Moscow companies. But AO MOSENERGO's claim was declined on formal grounds: the Moscow REC has invalidated its own decision and adopted a similar one.

To sum up, the Moscow government officials have failed to recognize the role of AO MOSENERGO. Too often they cite unproved and unreliable information and manipulate the facts. Such actions cannot be efficient as they complicate the complex AO MOSENERGO operations. It is not the populist approach that helps AO MOSENERGO to support the worn-out power system in working condition but the professionalism of many thousands of its employees.
