At the beginning of 2016 IDGC of Volga, PJSC collected more than 1 billion rubles from debtors through legal enforcement procedures

Since the beginning of 2016 IDGC of Volga, PJSC filed 224 lawsuits in an overall amount of 7.7 billion rubles. According to overwhelming majority of lawsuits, the court made decisions in favor of IDGC of Volga, PJSC. From January till May, 2016, the company received 1.1 billion rubles under previous court orders of enforcement.

According to the legislation, power engineers have the right to limit power supply of debtors. In real terms, it is rather difficult to do so. As a rule, the main debtors are last resort suppliers and power retail companies. To limit their power supply without limiting their own customers is practically impossible. Basic actions to pay the services provided become for inefficient companies an event that requires legal recourse.

The number of lawsuits from IDGC of Volga, PJSC is constantly increasing due to the increasing number of defaulters. Thus, in 2013 the company filed 516 lawsuits, in 2014 — 678, in 2015 — 957. As a matter of fact, claim administration becomes the primary means of recovering funds, which consumers should regularly pay under the terms and conditions of agreements with the power retail company. However, at least half a year or even more time passes from filing a lawsuit until receiving funds under court orders of enforcement. All this time mala fide payers continue to benefit from power retail companies at every possible way by making use of loopholes in laws to extend the terms of delivering a court decision. The actions of the power retail companies, supported by the funds collected from people and regional companies, poses a threat to large-scale preparation of electric networks for the upcoming autumn and winter seasons.

Under conditions of large-scale repair campaign, their underfunding may lead to extremely unfavorable consequences. An obstacle to such manipulations can be official Federal Law No. 307. Now penalties will be virtually comparable to bank loan rates. The problem is that many corporate debtors have damaged their business reputation and lack assets, that is why to obtain credit in a banking institution is practically impossible for them. In such situations, instead of improving operational efficiency, they prefer to take advantage of the money of the electric grid company. The references of the power retail companies — Saratovenergo, Chuvash Power Sales Company, Ulyanovskenergo and others — to the overall economic situation in the country are rather untenable. There is a great difference in payment discipline in one federal district, where IDGC of Volga, PJSC operates.

Most contracting parties of IDGC of Volga, PJSC in the Samara and Orenburg regions, the Republic of Mordovia find a way to fairly and duly pay power transmission services. Sales companies of the Saratov, Ulyanovsk, Penza regions and the Chuvash Republic either act extremely inefficiently, or use the money collected for purposes other than intended?
